Terms and conditions
These terms and conditions are a draft. Have them reviewed by a legal professional before using them.
1. Definitions
LegalCopyright.eu: the operator of the system that finds the use of images on the internet and arranges recognition for their creators.
Creator: the rights holder who registers images in order to receive recognition.
User: the person or organisation that publishes content containing an image managed by LegalCopyright.eu.
Publication: any placement of an image on a website, social media platform or other digital channel.
2. What we do
LegalCopyright.eu develops and operates a system that independently searches the internet for publications in which registered images are used. When our system identifies such use, we request a modest fee on behalf of the creator as a form of recognition. We do not litigate; we arrange recognition.
3. Registering as a creator
A creator registers by providing accurate details and an overview of their work. The creator warrants that they are the rights holder of the registered images. LegalCopyright.eu reserves the right to reject or remove registrations where ownership of the rights cannot be demonstrated.
4. Fee
For the use of an image in a publication, we request a fee of €24.10 per publication. This amount is intended as recognition for the creator and is considerably lower than the fees charged by many other organisations, helping to keep recognition accessible.
5. Payment and onward payment
After receiving the fee, LegalCopyright.eu arranges for the creator to receive the promised recognition. We aim to handle this process quickly and transparently. Any payment-processing costs may be deducted.
6. User obligations
A user who receives a notice about a publication must provide accurate information about the image used and the publication. The fee must be paid within the stated period, unless otherwise agreed in writing.
7. Liability
LegalCopyright.eu makes every effort to keep the system accurate and up to date. We are not liable for technical failures, missed detections or incorrect interpretations of image use. Our liability is limited to direct loss and, at most, to the amount paid for the publication concerned.
8. Term and termination
The agreement between LegalCopyright.eu and the creator continues until terminated. Either party may end the cooperation in writing. Following termination, no new publications will be monitored on behalf of the creator.
9. Amendments
LegalCopyright.eu may amend these terms and conditions from time to time. We recommend reviewing them regularly. We will actively inform affected creators and users of significant changes.
10. Governing law and disputes
All agreements with LegalCopyright.eu are governed by Dutch law. Disputes will be submitted to the competent court in the district of Utrecht, unless mandatory law provides otherwise.
